AREA OF PRACTICE

DEBT RECOVERY: 

This module is designed along the current practice of risk management prevailing in most of our institutions. The fast track debt recovery procedure is coined for the comparative advantage for which the module was designed to achieve.

OUR PROFESSIONAL STRATEGY: 

Due to the difficulties associated with debt recovery, AAA Chambers have adopted 3 main strategies in executing the debt recovery instructions we receive from our clients. In summary we have adopted settlement and arbitration, Mareva Injunctions and summary judgments.

RECEIVERSHIP AND GENERAL INSOLVENCY: 

We can rightly confirm to you that we consider receivership as one of the fastest ways of recovering indebtedness of a defaulting customer. It is a procedure wherein we approach the Court with an exparte application to take over collaterized assets without the knowledge of the customer. It is very fast because it has an element of surprise and it does not give room for frivolous appeals that will delay the taking over of the assets. We are available to give further clarifications on receivership.

WINDING UP & LIQUIDATION: 

It is simply a court order that permits us to wind up a company by virtue of the failure of the company to pay his debt from N2,000 {Two Thousand Naira Only} and above. The law allows us to commence winding up proceedings against a company for its failure to repay its debt. This further empowers us to dispose of the assets of the company in liquidation of its debt.

MAREVA INJUCTIONS & COURT ORDERS: 

It is simply a court order that permits us to freeze the assets of debtors, thereby frustrating them to repay their indebtedness to our clients. It is apposite to state here that, these orders are mostly granted ex parte because the debtor need not be aware and more so it is an order that is granted so as not to give the debtor opportunity to dispose off their properties while being indebted to individuals and organizations.

SUMMARY JUDGEMENT: 

This is provided for under our Court Rules to fast track the repayment of debts so as not to create further delay. It is noteworthy to state that in the spirit of ensuring fast track recovery effort, our Courts also have Fast Track Registries where cases from N100 Million are quickly determined. Conclusively, it is unarguable that the strategies discussed above will go a long way in fast tracking the repayment of indebtedness to our clients.

LAW ENFORCEMENT AGENCIES: 

We equally engage the services of law enforcement agencies in transactions we discover criminal intentions and illegal diversions.

PROPERTY LAW: 

Instituting and defending of actions for recovery of premises, Mortgage securities, Title transfer and perfection of title deeds, Registration of Debenture, mortgages, charges and releases.

INSOLVENCY PRACTICE: 

Personal & Corporate insolvency, Debt management and equity restructuring, Receivership and assets foreclosure. Our team members in the course of their individual careers have been involved in handling high profile recovery briefs for Banks and other organizations in different capacities. We have instituted actions both at the Federal High Court and the Lagos State High Court which the originating summons have been accompanied with motion for Mareva injunctions and summary judgment etcetera. We have equally been involved in prosecution of appeals both at the Court of Appeal and Supreme Court.
