Bankruptcy (Pasan)
A debtor is declared bankrupt, on its own application or a creditor's, once it is insolvent; a suspension of payment raises a presumption of inability to pay, and for a company, bankruptcy can be declared on balance-sheet insolvency (liabilities exceeding assets) alone, without a cash-flow test (Articles 305-306). A court-appointed trustee then liquidates the debtor's assets and distributes the proceeds by the same broad priority as a rehabilitation plan, secured claims before unsecured claims.
Discharge and what survives it
Once a bankruptcy case closes, the court grants the debtor a discharge (immunity, myeonchaek) unless bad-faith grounds apply, such as concealing assets or filing a falsified creditor list (Article 564); once final, discharge releases the debtor from the whole of its remaining bankruptcy debt beyond what was actually distributed (Article 565).
